These Terms of Use ("Terms") govern your access to and use of the Deep Core mobile application ("the App"), provided by Jonathan Buchan and Michele Marques operating as Mossy Arch Digital ("we", "us", "our"). By downloading, accessing or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
These Terms incorporate Apple's Standard End User License Agreement (EULA) by reference. Where these Terms and Apple's Standard EULA conflict regarding the App Store and in-app purchases, Apple's EULA governs that subject matter.
1. Acceptance of terms
By creating an account, completing onboarding, or otherwise using the App, you confirm that you are at least the age of digital consent in your jurisdiction and that you have read, understood and agree to these Terms and our Privacy Policy. If you are using the App on behalf of someone else, you confirm you are authorised to accept these Terms on their behalf.
2. Licence to use the App
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to download and use the App on Apple devices that you own or control, solely for your personal, non-commercial use. This licence does not allow you to share, resell, sublicense, or commercially exploit the App.
3. Health & fitness disclaimer
Deep Core provides general fitness and breathing-exercise guidance. It is not medical advice, diagnosis, or treatment, and it is not a substitute for professional medical care.
- Consult a professional. Consult your doctor or a qualified healthcare professional before beginning Deep Core or any exercise programme, particularly if you are pregnant, have an injury, or have a medical condition.
- Exercise at your own risk. You are solely responsible for exercising safely and within your own limits. If you experience pain, dizziness, shortness of breath or any discomfort, stop immediately and seek medical advice.
- No guaranteed results. Individual results vary. We make no guarantee of any specific health, fitness, or wellness outcome.
To the maximum extent permitted by law, we are not liable for any injury, loss or harm arising from your use of the exercises or guidance provided in the App.
4. Purchases & billing
Deep Core is free to use. All exercises and core features are available at no cost. The App also offers optional in-app purchases. All purchases are processed by Apple through your App Store account; we do not collect or store your payment-card details. The exact price and what each item includes are shown on the App's purchase screen before you confirm, and by confirming you authorise the charge to your App Store account.
One-time purchases (currently available)
Deep Core currently offers two kinds of optional one-time purchase. Neither is required to use the App, and neither unlocks or gates any exercise or core feature.
- "Support Deep Core" tip — a voluntary, one-time contribution to support development. A tip is a consumable purchase: it is used up when made, grants no ongoing benefit or content, and is non-refundable and cannot be restored to another device. Tips are a thank-you, not a product.
- Beanie outfits (cosmetics) — optional, one-time non-consumable purchases that change the appearance of your Beanie mascot. Outfits you buy can be restored at no extra charge on any device signed in with the same Apple ID, via the in-app restore option or Apple's standard restore.
Subscriptions (if offered)
Deep Core may, in the future, offer optional auto-renewing subscriptions that unlock additional content. If and when offered:
- Auto-renewal. Auto-renewing subscriptions renew automatically at the end of each billing period at the then-current price, unless you cancel at least 24 hours before the end of the current period.
- Managing & cancelling. You can view, manage or cancel a subscription at any time in your Apple ID account settings (Settings → [your name] → Subscriptions). Cancelling stops future renewals; the subscription remains active until the end of the current paid period.
- Free trials. If a free trial is offered, any unused portion is forfeited when you purchase a subscription, where applicable.
- Price changes. Where required, Apple will notify you and ask for your consent before a price increase takes effect; otherwise the change applies from your next renewal.
Refunds
All purchases are handled by Apple and are subject to Apple's refund policies. Refund requests must generally be made to Apple, not to us, via reportaproblem.apple.com. EU/EEA consumers may have additional statutory withdrawal rights; note that for a consumable tip that has already been delivered, the right of withdrawal may not apply once the contribution is made.
5. Acceptable use
You agree not to:
- Reverse-engineer, decompile, or attempt to extract the source code of the App, except where permitted by law;
- Use the App for any unlawful purpose or in violation of these Terms;
- Interfere with, disrupt, or attempt to gain unauthorised access to the App or its related systems;
- Copy, distribute, or create derivative works of the App or its content without our permission.
6. Intellectual property
The App and all of its content — including its design, code, text, graphics, animations, the "Beanie" mascot, logos, and trademarks — are owned by Mossy Arch Digital or its licensors and are protected by intellectual-property laws. Except for the limited licence granted above, no rights are transferred to you.
7. Third-party services
The App relies on third-party services, including Apple (App Store, iCloud, Sign in with Apple, push notifications) and PostHog (opt-in analytics). Your use of those services is also subject to their respective terms. Details of the data involved are in our Privacy Policy.
8. Disclaimers
The App is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including (without limitation) implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. Nothing in these Terms limits any warranty or right that cannot be excluded under applicable law, including mandatory consumer-protection rights in the EU/EEA.
9. Limitation of liability
To the maximum extent permitted by applicable law, Mossy Arch Digital and its operators will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, profits, or goodwill, arising from or related to your use of (or inability to use) the App. Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot be excluded under applicable law. Where liability cannot be excluded but can be limited, our total liability is limited to the amount you paid us (if any) for the App in the 12 months before the event giving rise to the claim.
10. Termination
You may stop using the App and delete it at any time. We may suspend or terminate your access if you materially breach these Terms or use the App in a way that could cause harm or legal liability. On termination, the licence granted to you ends; sections that by their nature should survive (including intellectual property, disclaimers, and limitation of liability) will continue to apply.
11. Changes to these terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you in the App. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.
12. Governing law
These Terms are governed by the laws of Germany, without regard to its conflict-of-law rules. If you are a consumer resident in the EU/EEA, you also benefit from any mandatory provisions of the law of the country in which you reside, and nothing in these Terms affects those rights. Disputes will be subject to the competent courts, subject to any mandatory consumer-jurisdiction rules that apply to you.
